Split Pot??? Help Please

Alright. heres the scenario. Texas Hold`em No Limit. The 5 Community Cards are ( 5 A 3 Q 3 ). The two remaining players have ( player 1: 6 3 ) ( player 2: 7 3 ). Do they use the 5 highest cards, meaning that they both would have equal hands ( A Q 3 3 3 ) and would have to split the pot, or would their second card in each of there hand (the 6 and the 7) be used to determine who gets the pot?

Alright, I had the same scenario. There was (Q Q 2 8 9) on the board, and player one, me, had (Q 5) and player two had (Q 7) and he was takling some stuff about best five card poker hand meaning like two pair is a poker hand and three of a kind is a poker hand, and that the other cards dont make a difference on the board because "you can't play the board and your hand at the same time." He said that his kicker, the 7, beat my 5, so he took the $8 pot. If there is someone with a ton of experience and that may have a credible reference on this, please post on it. Thanks.

this guy bent you over big time. should have definitely been a split pot. use 5 cards, and 5 cards only in determining your hand. THERE ARE NO SIXTH OR SEVENTH CARDS. you do not have to use any of your pocket cards if you don't want to. (not in hold 'em anyway) what you need to do is figure out if the guy you were playing with intentionally screwed you out half the pot or is just clueless about the rules.

Yes yes, that is most definitely a split pot.

Random sidenote to this post:

I understand that people new to the game will not be sure on rulings about the board, etc.

But does it blow anybody else's mind when you explain "you make the best five card hand out of the seven cards: five on the board, and two in front of you," and then show what the best five card hands are, people still don't get it??

"But I've got a 10 to his 7!"

"That's true. But your hands are identical: A A A K J."

"But my kicker is higher!"

"You do have a higher sixth card, but you are playing four from the board, the A A K J, and one from the hole cards, the third ace, meaning your hands are identical"

"What the f***, I have a higher kicker!"

Just an example of a situation I've seen more than once.

In fact, at one point in a homegame, I had to argue for 10 minutes because there was a flush on the board, sometin like 2 7 5 Q A of spades, and I had the K spades. Apparently, this guy thought it was a split pot, because we all had a flush.

I was ready to pull my hair out after that one. Luckily, they finally cracked, and gave me my pot ;P

There needs to be some like, poker police, that goes around with a billy-club, smacking anybody who can't handle the idea of using the best 5 of your 7 cards.

Or, all these players that can't understand playing Hold'Em like that, should sit down across from me at the PL Omaha Hi/Lo table ;P

I never play Omaha, so I'm not sure, but I think I remember reading that in that game you have to use your 2 hole cards plus any 3 on the board to make your hand. If that is true, then maybe that is where he got his idea from. But in hold'em, it's the top 5 cards, period.
