US News and World Report publishes Frank and Bachus argument
The two representatives each submitted their arguments. Decide for yourself which has the stronger position.

On a poker forum I imagine that position to be bias
But my thoughts on the law anyway:
-Hypocritical, since other forms of on-line gambling like horses and the lotto were exempt (not sure if that’s still the case).
-Against human nature, since it’s supposed to protect morons with no self control. I know a guy who’s £30K in dept with about £2K of assets to show for it and has never gambled in his life.
-Wont someone think of the children, since we have no adequate means to verify age’s on-line…which is also why all on-line porn is banned in the US.
Summary it’s a bad law but until someone turns around with some money or influence it’s unlikely to change.

Can you have professional poker players? Yes. If it was pure luck this wouldn’t be possible.
As for the arguments it’s not all about skill vs luck. The against are putting forward everything short of saying on-line poker funds terrorism.

I often wonder why fishing tournaments are considered legal skill based events in most jurisdictions (I'm not going to bother researching, but I'd guess Bachus' state of Alabama has its share of fishing tournaments) while poker tournaments are not...

I am of the opinion that the online gambling law and especially the online poker law is quite confusing. I am also of the opinion that online gambling does not harm anyone so why should it be illegal? I think that Barney Frank has a better point of view than Spencer Bachus.
