All In Out Of Turn Question
We had a situation where the flop came out, the 1st person checked, the 2nd person checked, the 4th person checked out of turn and the 5th person went All IN. The 3rd person realized that he was skipped and complained.
What should happen???

As ever - depends.
Some places I've played will say that action returns to player 3 but the all-in stands no matter what.
The more common ruling, and the one we use in our home game, is that the action returns to player 3 and unless he changes the course of events, all out of turn subsequent action remains. If he changes anything - eg in this case does something other than checks - action moves to player 4 who has the full range of options and player 5's all-in is no longer binding.
The reason the latter ruling is favourable is because a change in previous action can change the decisions made and therefore since player 3 can influence the hand in a way that players 4 and 5 had not seen, they should be given the option to change their minds.
Player 4 should received a warning/penalty for acting out of turn and so should player 5 for not paying enough attention and simply playing after player 4 rather than following the action and realising that player 3 had yet to act.
